Learned Counsel for the petitioner, upon instructions, seeks liberty to withdraw the petition. Liberty as prayed for is granted in the interest of justice.

Learned Counsel for the petitioner has drawn attention of this Court to clause (iv) of the operative order passed by the Additional Sessions Judge-2, Ambajogai. Learned Additional Sessions Judge has passed an order to the effect "The learned J.M.F.C., Ambajogai

( 2 ) crwp107.14 is hereby directed to complete above exercise within a period of two months to bring R.C.C. No.551 of 2009 on right track".

It is clarified by this Court that the only meaning that could be inferred that the learned J.M.F.C. is directed by the Additional Sessions Judge, Ambajogai to pass appropriate orders in accordance with law. 4.

The writ petition is dismissed as withdrawn. All contentions are kept open for any further proceedings.
