Prayer clause 'B', the principal prayer in the petition reads thus :
"By issuing writ of Mandamus or any other writ, order or direction in the like nature, may kindly be direct to the respondent no. 2 to absorb the petitioner as "Untrained Assistant Teacher" in the Zilla Parishad primary school as per the Government resolutions dated 31.7.2009, 27.9.2011, 01.03.2014 and for that purse issue necessary order."

Learned counsel for petitioner submits that representation on behalf of the petitioner and similarly circumstanced teachers was submitted to the Chief Executive Officer, Zilla Parishad, Beed, in the year 2014 and, no decision was taken on the representation. Learned counsel invited our attention to the policy of the State
{2} wp2226.19.odt Government reflected in the Government Resolution dated 27.09.2011 wherein the State Government took a cautious decision to absorb/accommodate teachers who are left as excess teachers on account of closure of Vasti schools for various reasons. Representations were submitted to the Block Education Officer and to the Education Officer in the year 2014. 4.
Learned counsel for petitioner submits that, for better appreciation, the petitioner would submit a fresh representation to respondent no. 2 - Chief Executive Officer, Zilla Parishad, Beed, raising grievance and also appraising respondent no. 2 about the policy of the State Government reflected in the Government Resolution dated 27.09.2011 within two weeks from today. In case, such a representation is submitted by petitioner to respondent no. 2 - Chief Executive Officer, Zilla Parishad, Beed, within stipulated period of two weeks from today, the Chief Executive Officer, Zilla Parishad, Beed, to decide said representation within six weeks from the date of receipt of the representation by him. 5.
