ORAL JUDGMENT (Per Anoop V. Mohta, J.) :

Rule. Rule made returnable forthwith and heard finally by consent of learned counsel appearing for the parties. 2.

Learned counsel appearing for the petitioner has pointed out from the affidavit filed by respondents No.2 and 3, whereby it is mentioned as under :

"I say that, in view of the report the Commissioner by letter dated 6.5.2015 has appointed Shri Hitesh Vispute, Chief Accountant as Enquiry Officer and Shri M.D. Kakde, Junior Engineer, Water Supply Department as Presiding Officer."

The prayer clause (B), therefore, not pressed. 3.

So far as the other issue with regard to the promotion, as stated to be pending in view of the pendency of this petition, we are inclined to dispose of this prayer also by permitting the petitioner to file a representation within two weeks from today on the issue of promotion. The respondents concerned to deal with the same in accordance with law as early

as possible, preferably within four weeks from the date of its receipt.

Writ Petition is accordingly disposed of. Rule made absolute in above terms. No costs.
