Heard learned Counsel Mr.Pradeep Deshmukh appearing for the petitioners and learned Counsel Mr. Navandar for respondent No.1.

Perusal of the order sheets shows that on 22.03.2018 this Court was pleased to issue notice to respondent No.l only, considering the grievance raised by the petitioner in the petition. The grievance of the petitioner was willful disobedience of the order of this Court dated 03.10.2017. Perusal of the order dated 03.10.2017 passed by the Division Bench shows that the respondent was directed to deposit the balance 50% amount in this Court within twelve weeks from the date of the

( 2 ) order. On such deposit the applicant was permitted to withdraw 50% of the additional amount without any security, however, on furnishing an undertaking in favour of the Registrar (Judicial). The Division Bench then directed to deposit 50% balance additional amount. The Division Bench also permitted the applicant to withdraw 50% amount on furnishing solvent surety/security to the satisfaction of the Registrar (Judicial). It was submitted that inspite of directions of this Court, the amount is not deposited in this Court. As such, the respondents committed willful disobedience of the order of this Court.

Learned Counsel Mr. Navandar for respondent No.1 today placed on record a copy of receipt to submit that as per directions of this Court, respondent No.1 deposited an amount of Rs.6,92,89,174/- (Rupees Six Crores Ninety Two Lakhs Eighty Nine Thousand One Hundred Seventy Four Only) on 29.05.2018. Learned Counsel Mr. Navandar fairly submitted that though there was stipulation of period in the order, the amount could not be deposited within the stipulated period and by way of pursis, request was made to this Court to extend the period. On submission of the pursis by order dated 27.04.2018, respondent No.1 was permitted to deposit the amount within the extended period.

As the direction of this Court for depositing the amount is duly complied with within the extended period, the purpose of approaching this Court is served. The order is duly complied with. Learned Counsel Mr. Deshmukh for the petitioner also submits that the order of this Court is complied within.
