When we point out that going by the present prayer clauses, wherein the petitioner is taking exception to the mutation certified under the provisions of the Land Revenue Code and the Rules framed thereunder, would be susceptible to a challenge by resorting to a remedy available under Chapter 13 of the Maharashtra Land Revenue Code, the petitioner in person started agitating that inspite of his repeated requests, he has not been provided with the documents. Without whispering as to why he could not resort to the mechanism provided thereunder for taking exception to the mutation entry, he is khs/Jan.2025/923

- 2 - objecting, he seeks leave of the Court to amend the petition and prayers.

The writ petition is disposed of by permitting the petitioner to resort to the appropriate remedies as are available in law either to challenge the mutation by resorting to the remedy under Chapter 13 of the Maharashtra Land Revenue Code or by resorting to the appropriate remedy as is available to the petitioner in law, including filing of a fresh petition in respect of the grievance he is now making for failure of the department in furnishing him the copies of the documents.
