Perused the papers. Three months time was granted to the applicant to undergo various surgery as requested by the applicant himself. However, the applicant is again coming with the same case that he could not undergo surgery due to some unfavourable clinical tests. Hence, further three weeks time may be extended.

When the application was filed, the applicant has came with the case that he has to undergo various surgery, but he did not undergo a single surgery within three months. However, he has submitted some pathological report and last

certificate dated 17.01.2023 of Doctor that he is unfit to undergo surgery till control of Diabetes Mellitus with peripheral neuropathy. The Doctor diagnosed that the blood sugar and HbA1c is high. The conduct of the applicant does not seem bonafide. He spent about three months only on treatment. When he sought the temporary bail, he made a statement that he has to undergo surgery after certain tests. The certificate of Doctor dated 17.01.2023 also does not inspire the confidence. The applicant was to surrender by today, but today also he is seeking time. The Court is not satisfied with the material placed on record and not find it fit to extend further time. Hence, the applicant to surrender by tomorrow.

The Criminal Application stands dismissed.
