In view of order dated 9.4.2014 passed in civil application No. 2479 of 2013 (in F.A. No.1288 of 2012) and other connected matters arising out of same land acquisition proceedings, the applicants are allowed to withdraw 50% of the deposited amount, upon execution of an undertaking that in case any order adverse to the interest of the applicants is passed in the first appeal/s, they would refund the same. The applicants are further allowed to withdraw the balance 50% amount, upon furnishing continuing guarantee from a nationalized bank to that effect. Civil application is disposed of accordingly.
