IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

BENCH AT AURANGABAD CONTEMPT PETITION NO. 72 OF 2017 IN WRIT PETITION NO.7136 OF 2015 Syed Asad s/o Syed Yusuf ..Petitioner

Versus

The State of Maharashtra and ors.

..Respondents Mr R.P. Dhase, Advocate for petitioner Mr K.N. Lokhande, A.G.P. for respondents no.1 to 4 Mr N.S. Kadam, Advocate for respondent no.5 Mr O.B. Boinwad, Advocate h/f Mr S.M. Kulkarni, Advocate for respondents no.6 to 8 CORAM : S.V. GANGAPURWALA & A.M. DHAVALE, JJ DATE : 25th January 2018 PER COURT 1.

We have heard learned Counsel for the respective parties. 2.

It is submitted that after the order is passed by this Court on 19th July 2016 in Writ Petition No.7136 of 2015, the Education Officer (Primary) has decided the proposal of the petitioner and has rejected the same under order dated 5th June 2017 and thereafter, as the number of writ petition was wrongly stated in his order, he has corrected the same under order dated 20.1.2018. 3.

In fact, the Education Officer, while deciding the proposal ought to have given entire reasons and ought not to have given reasons in piecemeal.

4.

As the proposal is already decided by the Education Officer and it is rejected, the petitioner may assail the said order in appropriate proceeding.

C.P.72/2017 5.

As the contempt stands purged, the Contempt Petition is disposed of. No costs.
