By this petition, the petitioner seeks to assail the order dated 28th April, 2009 passed by the Chief Executive Officer, Zilla Parishad, Aurangabad by which the probation tenure of the petitioner as a Shikshan Sevak, has been extended by one year. Specific reasons have been assigned in an inquiry report that was tendered by the centre head. It was noticed that some of the Shikshan Sevaks had indulged in making interpolation in the answer-sheets, increasing the marks of the students, showing favouritism to the students whose attendance was abysmal, writing answers for the students, misplacing answer-sheets etc. The Petitioner is one of them. 2.

We are not inclined to entertain this petition, since the statutory remedy available as in 2009 was not availed of by the

919 WP.2568.2021 petitioner. The petitioner accepted the decision of the Chief Executive Officer of extending the probation period by one year. She is now confirmed in employment and now is an Assistant Teacher. This petition has been filed in January, 2021, after 12 years. 3.

Considering the delay and there being no justifiable explanation as to why the petitioner did not challenge the said impugned decision and in the backdrop of having accepted the said decision, this petition does not deserve to be entertained. The same is, therefore, dismissed.
