RELIANCE GENERAL INSURANCE COMPANY THR ITS MANAGER YOGESH DILIP DHASE AND OTHERS ...
Advocate for Applicants : Darandale Abhijit C. Advocate for Respondent No. 1 : S.S. Patil ...
CORAM : T.V. NALAWADE, J.
DATED : 22nd February, 2016.
ORDER :
1.
The application is filed by original claimants for permission to withdraw the compensation amount. The learned counsel for Insurance Company has strong objection to it. The learned counsel submitted that involvement of the vehicle itself is under challenge. The admitted fact is that police filed case against the driver of tipper after making investigation, though initially other vehicle was described in M.L.C. There is dispute over the quantum also. One salary certificate is considered after giving exhibit. In view of these circumstances, this Court holds that permission needs to be granted to withdraw the amount deposited in this Court subject to condition of giving undertaking.
CA No. 2066/16 2.
In the result, the application is allowed. After undertaking given by the claimants, make the disbursement as per the award.
