The learned Advocate for the petitioner submits that this Court had admitted the petition on 3rd July, 2001 and refused interim relief to the petitioner. He was awarded a punishment by the impugned order dated 27th August, 1997, which has been confirmed by the Additional Divisional Commissioner, Aurangabad, in the disciplinary proceedings. Despite his efforts, the petitioner is not responding and is not passing on instructions to the learned Advocate.

In view of the above, this petition is dismissed on account of non-prosecution.

Rule is discharged.
