This application is filed under section 439(2) of Cr.P.C., seeking cancellation of anticipatory bail granted to respondent No.2 by the learned Additional Sessions Judge, Aurangabad, vide order dated 04/01/2021, in Crime No.397/2020, registered with Satara Police Station, Aurangabad, for offence punishable under sections 323, 379, 504 of the Indian Penal Code.

Heard learned advocate for applicant, learned Additional Public Prosecutor for State and learned advocate for respondent No.2. Perused the documents placed on record. 3.

During the course of hearing, it is revealed that chargesheet is filed in the present crime on 10/02/2021. The case is numbered as R.C.C. No.2469/2021 and the matter is kept on 04/03/2023 for appearance.

Considering the above, it is not desirable to cancel the anticipatory bail granted in favour of respondent No.2 in the year 2021. Application is, therefore, rejected.
