Heard learned Counsel for the applicant - wife. The respondent husband, though served with the fnal disposal notice, remained absent.

The applicant - wife is seeking transfer of HMP No. 246 of 2021 pending in the court of Civil Judge (Senior Division), Pandharpur, District Solapur fled by the respondent husband for getting divorce, to the Court of Civil Judge (Senior Division), Aurangabad. According to the applicant-wife, the distance between Pandharpur and Auragabad is of 400 kms and therefore, it is highly diffcult for her to attend the dates at Pandharur. Further, the applicant is also intending to fle proceedings for restitution of conjugal rights at Aurangabad. At present, she is not having any independent source of income. As such, considering the convenience of applicant,

ORDER

(i) The application is hereby allowed.

(ii) HMP No. 246 of 2021 pending in Court of Civil Judge (Senior Division), Pandharpur, District Solapur is transferred to the Court Court of Civil Judge (Senior Division) at Aurangabad for disposal according to law.

(iii) The respondent is directed to appear before the learned Civil Judge (Senior Division), Aurangabad on 21st November 2022.

(iv) The application is disposed of accordingly.
