Shri S. G. Karlekar, A.G.P. for Respondent Nos. 1 to 6 in W. P. No. 1023 of 2018.
Shri K. N. Lokhande, A.G.P. for Respondent Nos. 1 to 6 in W. P. No. 1026 of 2018.
CORAM : S. V. GANGAPURWALA AND A. M. DHAVALE, JJ.
DATE : 14TH FEBRUARY, 2018.
FINAL ORDER :
.
According to petitioners, tribe certificates of the petitioners were taken back by the respondent No. 3. It is further submitted
2 wp 1023.18 that, the said tribe certificates are not returned back. 2.
We have heard respective learned Assistant Government Pleaders for respondents.
3.
It appears that, the case of the respondent No. 3 is that, the respondent No. 4 required said certificates for investigation, as there was doubt about the genuineness of the certificates. 4.
The said doubt is misplaced, as tribe certificates were directed to be issued under the order of this Court in writ petition filed by one of the petitioner and by order of the Scrutiny Committee. In view of that, the genuineness of the certificates would never be in question. Even otherwise, whenever authorities require the original tribe certificates, they can call the same from the petitioners.
5.
In view of the above, the concerned respondent shall return the original tribe certificates to petitioners expeditiously and preferably within a period of four (04) weeks from today. The writ petitions are disposed of. No costs.
