I have hard the learned counsel for the petitioner for some time.

The learned AGP has raised a preliminary objection that in terms of the ratio laid down in a case of Gurudassing Nawoosing Panjwani Vs. State of Maharashtra and others. reported in 2015 (6) Mh.L.J. 915, alternate effcacious remedy of fling the second revision before the State is available to the petitioner.

Learned counsel for the petitioner has also not disputed this legal position.

In view of the above, writ petition is disposed off with the liberty to the petitioner to avail the alternate remedy as is available in law by fling the revision before the State and, upon fling such a revision, the time spent in pursuing this writ petition may be considered for condonation of delay, if caused in preferring the revision.
