Heard. There is an innocuous prayer in the petition in as much as direction is sought to respondent Nos.3 and 4 for removal of alleged encroachment and illegal construction in Survey No.97 and 98, situated at Kallam, Dist. Osmanabad.

We direct respondent Nos.3 and 4 to take appropriate decision in respect of grievances raised by the petitioner by way of filing various applications/ representations, as expeditiously as possible, however, within six months from today. Needless to observe that while taking such decision, respondent Nos.3 and 4 shall adhere to the provisions of the relevant Act, Rules and procedure and thereafter take appropriate decision, after adhering to the principle of natural justice. We make it

( 2 ) wp1514.18 clear that before taking such decision, if the law mandates that affected persons should be heard, in that case it is for respondent Nos.3 and 4 to adhere to such provision and then take decision.
