1) The application is filed for quashing of the charge sheet, RCC No.24/2009 presently pending in the Court of the Judicial Magistrate, First Class, Gangapur for offences punishable under sections 326, 323, 504, 506, 34 of the Indian Penal Code. The complainant and the injured witnesses have settled the dispute with the accused. Accordingly, affidavits are filed by Kachru, Eknath and Pushpa. Pushpa had sustained fracture injury due to blow

2 Cr Application 419/2015 of stick. It was a private dispute. In view of these circumstances, this Court holds that it is not desirable to allow the proceeding to go on.

2) In the result, the application is allowed. The proceeding is quashed and set aside.
