This writ petition is filed challenging the order passed by the learned Adhoc District Judge-1, Osmanabad in Regular Civil Appeal No. 88/2024 thereby allowing the application below Exh. 5 filed by the respondents/appellant/original defendants. By way of order the execution of decree and order passed by the learned Trial Court is stayed.

The learned advocate for the petitioner though tried convince this Court on merits of the matter, this Court finds that, there is no perversity in the order as pending the appeal the Court has granted stay. At the most, direction can be given to dispose fo the appeal as
