Heard learned A.P.P. for the applicant/ State. Perused the finding recorded by the trial Court. Prima facie it appears that, the trial Court has not properly considered the evidence of the eye witnesses including injured witness and also awarded inadequate sentence. In that view of the matter, case is established for allowing the application. Application is allowed in terms of prayer clauses, A, B, C and F. 2.

Appeal is admitted.

Action under Section 390 of the Code of Criminal Procedure to follow before the Sessions Court, Aurangabad.
