Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The prosecution has a case against the applicant that he plotted the conspiracy to commit murder. The prosecution has a sole conversation between the applicant and co-accused Ravi Kholam, who has been granted bail. Admittedly, the applicant was not present on the spot of the incident. Nothing has been recovered from the applicant. It is a case of political rivalry. The other evidence against the applicant that he had residence within the periphery of the spot of the incident. The investigation has been completed. Nothing remained to be interrogated from the applicant. However, considering the
rivalry and apprehension of repeating the crime, certain stringent conditions may be imposed. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant BHANUDAS MAHADEV KOTKAR @ BM be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.136 of 2018, registered by Police Station Kotwali, District Ahmednagar, for the offences punishable under Sections 302, 303, 120-B, 143, 144, 145, 147, 148, 149, 504, 506 read with Section 34 of the IPC and Section 3/25, 4/25 of the Arms Act on the following conditions :
(a) The applicant shall not tamper with the prosecution witnesses.
(b) He shall not enter Ahmednagar town for six
(6) months from the date of his release except for attending the trial before the learned Sessions Court at Ahmednagar.
(c) During the stay out of Ahmednagar, he shall give his mobile phone number and residential address to the police.
