1] The present Civil Application is filed to bring on record legal heirs of deceased Pasha Begum Sarwar by condoning delay of 565 days in filing the present civil application.

2] The learned counsel for the petitioner [respondent no.1 in Civil Application] submits that the petitioner does not want to proceed against the legal heirs of the deceased respondent no. 6 - Pasha Begum Sarwar Patel.

2179.24CA 3] Liberty is granted to place on record pursis in the registry to that effect.

4] Since the respondent no. 6 has expired long period of time, the petition stands abated qua respondent no.6.

5] Since the learned counsel for the petitioner contended that the petitioner does not want to proceed against the legal heirs of the deceased respondent no. 6 - Pasha Begum Sarwar Patel, at the request of the applicant, the application filed to bring on record the legal heirs of the deceased respondent no. 6 Pasha Begum is disposed of with liberty to the applicants to initiate any other proceedings as may be available in law.
