This is an application seeking condonation of delay that is caused in fling the application seeking leave to fle appeal against acquittal. Delay is of 34 days. The learned Advocate submits that, delay is not intentional, but is caused because of the reasons stated in the application. 3.

Learned Advocate for the respondent opposed the application saying that now respondent is acquitted and there is no merit in the appeal.

Considering that period of delay is 34 days, and for the reasons assigned in the application, the same deserves to be condoned. The application is therefore allowed. Delay in fling Criminal ALP is condoned. Offce to register and number the Criminal ALP. Criminal application stands disposed off.
