Present application has been filed by the claimant for getting delay of 731 days condoned in filing first appeal. The claimant intends to challenge the judgment and award passed by the reference Court for enhancement.

Learned Assistant Government Pleader representing respondent no.01 strongly opposes the application on the ground that the reason that has been mentioned for condonation of delay is not sufficient and reasonable.

Taking into consideration the fact that the
(Order) (2) C.A. No. 4330 of 2012 applicant is an agriculturist, coming from rural area and whose land was acquired; leniency is required to be shown and hence the delay stands condoned. The application stands allowed and disposed of. It is clarified that the applicant is not entitled to get interest of 731 days in case of success in his appeal. Registry to verify and register the first appeal and place it for further consideration on 14th November 2019.
