Issue notice to the respondent. Learned AGP waives service of notice for the respondent-State.

This is a successive bail application on parity. It has been argued that the role attributed to the applicant is identical to the role attributed to co-accused Suryakant, who has been granted bail.

Learned APP has verified the papers and satisfied that the role of this applicant is identical to the role of co-accused Suryakant. Since the role of these two persons are identical, the applicant deserves parity. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant DATTAPRASAD CHANDRAKANT BIRADAR be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, in Crime No.245 of 2021, registered by Police Station Udgir Rural, District Latur, for the offence punishable under Section 302 read with Section 34 of the IPC, on the following condition :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall attend the trial on each and every effective date.

(c) He shall not protract the trial.

(d) He shall not indulge in a similar offence.
