This Review Application has been filed within limitation. 2.

We have considered the lengthy submissions of the learned Advocate for the Review Applicant(Original Petitioner). We have perused the grounds set out, wherein, we hardly find that there is any explanation as regards the deliberate act of suppression of material facts from this Court, which was considered vide the Judgment dated 10.01.2024, delivered in Writ Petition No. 9456 of 2023 filed by the present Applicant.

We have relied upon the law laid down by the Hon'ble Supreme Court in Kishore Samrite Vs. State of Utter Pradesh and others, (2013) 2 SCC 398 and Bhaskar Laxman Jadhav & others Vs. Karamveer

RA26-24 Kakasaheb Wagh Education Society and others, (2013) 11 SCC 531 and we have concluded that the Petitioner does not deserve any sympathy. We have also noted that the Petitioner had made a dishonest attempt before the Court of Criminal jurisdiction.

In view of the above, a ground such as "the Petitioner has blood pressure and blood sugar" and "does not have a good source of income", cannot be a ground to show sympathy towards a litigant who attempted to mislead the Court and extract an order. 5.
