Matter was sent for mediation. In accordance with that the parties have appeared before Mediator Advocate Mr. S. K. Kadam and settled the dispute.

The mediator has fled his successful report specifying the terms of the settlement. Both the learned counsel admitted that the matter is settled by way of mediation. In view of that, appeal stands disposed of in terms of mediation report which is marked as article 'A'.
