1] Heard. For the reasons stated in Criminal Application No. 254 of 2025 for assisting to the PP, the same is allowed.
2] Heard learned counsel for the applicant, the learned APP for the respondent-State and advocate for assisting to APP.
3] The applicant is apprehending arrest in connection with Crime No.489 of 2024, registered at Modha Police Station, District Parbhani, for the offences punishable under sections 118(2), 115(2), 352, 351(2) and (3), 3(5) of
Bharatiya Nyaya Sanhita, 2023.
4] The incident is dated 18.10.2024. It appears that there was fight between two groups and both the parties have suffered injuries. The applicant in this scuffle has suffered grievous injury whereas injuries inflicted on the informant are minor and simple in nature. It is also informed that in the cross F.I.R. the applicant has registered F.I.R against the informant and he is granted anticipatory bail. Considering the above, the applicant is also granted anticipatory bail.
5] In view of the above, the application is allowed in the following terms :
i] In the event the applicant/s is/are arrested in connection with Crime No.489 of 2024, registered at Modha Police Station, District Parbhani, for the offences punishable under sections 118(2), 115(2), 352, 351(2) and (3), 3(5) of Bharatiya Nyaya Sanhita, 2023, he shall be released on bail on furnishing PR bond of Rs. 20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.
ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall
not influence the informant, witnesses and other persons concerned with the case.
iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.
6] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled.
7] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
8] The application stands disposed of.
