IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 9 CONT. PETITION NO. 49 OF 2015 IN WP/243/2007 SHIRISH MUKUNDRAO PATIL AND ANOTHER

VERSUS

SANJAY CHAHANDE AND OTHERS ...

Advocate for Petitioners : Mr. S.R.Barlinge Advocate for respondent no. 3 : A.S.Deshpande ...

CORAM : S.V.GANGAPURWALA AND SUNIL K.KOTWAL, JJ.

DATE : JUNE 19, 2018 O R D E R :

The contempt is filed for dis-obedience of the order of this court dated 4.7.2014 passed in the writ petition no. 243 of 2007. The respondents have filed affidavit stating that the order is complied with. According to the respondents, the respondents are liable to pay amount of Rs, 7,18,574/- as per the order of this court.

2.

According to Mr. Barlinge, learned counsel, the State Government had sanctioned an amount of Rs.

cp49.15 11,00,436/- as the amount due and payable. According to order passed by this court, of which contempt is alleged, the Joint Director could not have reduced the amount and no details have been given why the amount is reduced. 3.

This court had directed the respondents to consider the pay scales applicable to the petitioner as Laboratory Assistant in the scale of 4,000/- to 6,000/-. Probably, now the dispute between the parties appears to be about the nature of the post and the grade pay payable, so also the benefit of time bound pay scale.

4.

In contempt petition, we may not go into the dispute about these aspects. If the petitioner is aggrieved by the quantum of amount paid, the petitioner is at liberty to take appropriate proceedings.

5.

In the light of above, the contempt petition stands disposed of. No costs.
