For the reasons stated in the application, Criminal Application No. 485/2016 to assist A. P. P. is allowed. 2.

The applicant is seeking pre-arrest bail in Crime No. I-403/2015 registered with Kotwali Police Station, Ahmednagar, Dist. Ahmednagar for the offence punishable under Sections 420 read with 34 of the Indian Penal Code and under Sections 65, 66-D of Information Technology Act.

Perused the investigation papers and allegations in the F. I. R.

Even though, applicant is proprietor of the firm, who was organising tours, there is hardly any communication between the applicant and complainant and no specific role is attributed to the applicant and there is no material in the F. I. R. to connect the applicant in crime in question.

In that view of the matter, in my opinion, applicant is entitled to enlarge on bail. Hence I pass following order. In the event of arrest, applicant be released on bail, in connection with Crime No. I-403/2015 registered with Kotwali Police Station, Ahmednagar, Dist. Ahmednagar for the offence punishable under Sections 420 read with 34 of the Indian Penal Code and under Sections 65, 66-D of Information Technology Act, upon executing P. R. Bond of Rs. 25,000/- with one surety in the like amount. The applicant shall attend the concerned police station from 27th to 30th January, 2016 between 10.00 a. m. to 12.00 noon and thereafter as and when called for by the Investigating Officer. 6.
