.
It is an application for bail moved by the applicant by taking aid of Section 439 of the Code of Criminal Procedure. Heard Mr. Patwardhan, holding for Mr. Jadhav, learned counsel for applicant and Mr. Morampalle, learned APP for respondent/ State.
On going through the police papers and the report made available by Mr. Morampalle, learned APP, it is evident that the applicant came to be arrested on 5th December, 2019, in connection with Crime No.180 of 2019, registered with Yusuf Wadgaon, Police Station, District Beed, for the offence punishable under Sections 307, 323 and 504 read with 34 of the Indian Penal Code.
Mr. Morampalle, learned APP for the State invited my attention to the report, which is made available for perusal of this Court. On going through the same report dated 09th March, 2020, it would be clear that the investigation officer has submitted 'C' summery report before the JMFC Court at Kaij. On going through the report submitted by the API, Police Station Yusuf Wadgaon, it is revealed that the FIR came to be registered on account of previous fracas and due to misunderstanding between the first informant and this applicant. Having regard to the above scenario, there is no need to keep the present applicant behind bars. He needs to be enlarged on bail. Hence, the following order is pass:
O R D E R
