It is a matter under Section 138 of the Negotiable Instruments Act.1881, pending before the trial Court. Recording of evidence for the complainant is over. It is now turn of the petitioner/ accused to lead his evidence. It appears that the trial Court has closed his evidence, because he was consistently absent before the trial Court. In the interest of justice and to give an opportunity to meet the case of the complaint, the order dated 05.01.2022 impugned herein is hereby set aside.

The trial Court is requested to give an opportunity to the petitioner herein to examine himself and any other witness, if any. The exercise shall be done within a period of four months from the date of receipt of copy of this order.
