Learned Counsel for the petitioner submits that during pendency of this writ petition, First Information Report bearing No. 0572/2021 came to be registered at Omerga Police Station, District Osmanabad. Learned Counsel for the petitioner, thus, on instructions, seeks leave to withdraw this petition. Leave granted. Writ Petition is dismissed as withdrawn.

Learned Counsel for the petitioner submits that by an order dated 05.02.2021, this Court has directed the petitioner to

{2} crwp111.21.odt deposit an amount of Rs.25,000/- (Rs. Twenty fve thousand) to show his bona fdes. The petitioner has accordingly deposited the said amount before this Court. Learned Counsel for the petitioner submits that the petitioner is entitled to the refund of the said amount deposited before this Court. Learned Counsel for the petitioner has placed before us a copy of the First Information Report. On perusal of the same, it appears that the petitioner herein is also implicated as accused no.2 in connection with the said crime.

We request the learned A.P.P. to take specifc instructions, particularly, as to the role allegedly played by the petitioner herein in connection with the said crime and further to make appropriate submissions on the basis of said instructions as to whether the petitioner is entitled to the refund of the said amount.
