The applicant apprehends his arrest in connection with Crime No.296 of 2022 registered with Yermala Police Station, District Osmanabad for offences punishable under sections 394 read with 34 of the Indian Penal Code. 2.
FIR is lodged by Avinash Anantrao Jadhavar alleging that in the night of 04/11/2022, robbery has taken place at his house, and gold ornaments and valuable articles were stolen from his house. During the investigation, some of the accused persons were arrested, and the main accused and his brother have allegedly disclosed that they have sold some gold ornaments to the present applicant.

Heard learned advocate for the applicant and learned Additional Public Prosecutor for the State. Perused the investigation papers.

It appears from the investigation papers that the main accused has disclosed to the Investigating Officer that previously also in 2 incidents of robbery, he had sold the stolen golden ornaments to the present applicant. However, that statement found to be false.

In the present case, the applicant, after granting interim protection, has attended the police station and co-operated in the investigation. He has handed over his daily registers to the Investigating Officer.

The investigating Officer is seeking custody of the applicant for further interrogation. For that purpose, the custody of the applicant is not necessary, and the applicant can be directed to attend concerned police station, and co-operate in the investigation. The applicant has no criminal antecedents.

In the result, application is allowed by confirming interim protection.

In the event of arrest of the applicant in Crime No.296 of 2022 registered with Yermala Police Station, District Osmanabad for offences punishable under sections 394 read with 34 of the Indian Penal Code, the applicant shall be released on executing Personal Bond of Rs.15,000/- with one surety in the like amount. The applicant shall not tamper prosecution evidence.

The applicant shall attend the concerned police station every day from 01st March, 2023 to 06th March, 2023 between 10.00 a.m. and 12.00 noon, and shall co-operate in the investigation.

Thereafter, till filing of the charge-sheet, the applicant shall attend the concerned police station as and when called by the Investigating Officer, and shall co-operate in the investigation.
