Heard learned Counsel for the applicants and learned Counsel for the respondent. For the reasons stated in the application and having considered the grounds of objection raised in exception to the impugned judgment and award, I deem it appropriate to pass the following order:

ORDER

1.

The applicants are permitted to withdraw 50 per cent of the amount deposited by the appellant / respondent No.2 Insurance Company before the learned Commissioner for Workmen's Compensation at Osmanabad, towards compensation along with the interest accrued thereon by submitting an undertaking to the effect that in the event any adverse order is passed - AGP/-

IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD (2) CA NO.15256/2016 against the applicants, the applicants will redeposit the said amount within a period of four months of passing such order. Balance 50 per cent amount be kept in any nationalized Bank in Fixed Deposit Receipt, initially for a period of two years, and if so required, to renew the said Fixed Deposit Receipts for further period, till disposal of the appeal. Civil Application for withdrawal of amount stands disposed of in above terms.
