DATE : 27TH JANUARY, 2016.
PER COURT :
.
We have heard Mr. Deshmukh, the learned counsel for the review applicants, Mr. Choudhari and Mr. Patil the learned counsel for respective respondents. The submission is made that, this Court has disposed of the writ petition by giving directions to the respondent No. 6 that the appeal shall be decided expeditiously and preferably within a period of six months. According to the review applicants, said appeal was already decided by the S. L. R. on 07.12.2015, however, this fact could not be brought to the notice of this Court.
2 ra 20.16 2.
Mr. Choudhari, the learned counsel submits that, review applicants have erroneously stated that, the advocates were aware of that fact, present respondents were not aware of the said fact.
3.
Mr. Patil, the learned counsel also submits that, his respondents also were not aware of the order passed by the S. L. R.
4.
Be that as it may, it appears that, the factum of appeal being decided by the respondent No. 6 was not brought to the notice of this Court when the order was passed. Considering above there is an error apparent on the face of record. Therefore, order dated 08.01.2016 in Writ Petition No. 7542 of 2015 is recalled. The Writ Petition No. 7542 of 2015 is restored to its original position. The review application is disposed of. [ A. M. BADAR, J. ] [ S. V. GANGAPURWALA, J. ] bsb/Jan. 16
