IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 7071 OF 2017 NANDOBAI KASHINATH CHAVAN DIED LRS RAMESH KASHINATH CHAVAN AND OTHERS
VERSUS
THE STATE OF MAHARASHTRA AND ANOTHER ...
Advocate for Petitioners : Mr. Patil Paresh B. AGP for Respondents: Mr.
Advocate for Respondent No.2 : Mr. Shivraj V. Deshmukh .....
CORAM : V. K. JADHAV, J.
DATED : 28th NOVEMBER, 2017 PER COURT:- 1.
Learned counsel for the petitioners, on instructions, seeks leave to withdraw this writ petition. Leave granted.
2.
Learned counsel for the petitioners submits that the Sub Divisional Officer has rejected the revision petition preferred by the petitioners and being aggrieved by the same, the petitioners have approached the Additional Collector. In terms of provisions of Section 249 (2) of Maharashtra Land Revenue Code 1966, if any order, passed in revision varying or reversing any order, shall be appealable as if it were an order passed by the revisional authority in appeal. However, in terms of provisions of section 252(b), no appeal shall lie from the order rejecting an application for revision or review of the order. Learned counsel submits that in view of same, the petitioner intends to file writ petition to challenge the order passed by the Sub Divisional Officer, rejecting thereby the revision preferred by the petitioner. Writ petition is accordingly disposed of as withdrawn.
