We have heard Mr. Kulkarni, learned counsel for the petitioners on merits also. We have also heard learned AGP for the State and Mr. Dhorde, learned counsel for the respondent No.3.

2. On merit, we are not inclined to consider the case of the petitioners. However, Mr. Kulkarni, the learned counsel submits that earlier also, the petitioners had filed petition bearing Writ Petition No. 2917/1995 and an affidavit was filed by the State saying that the subject matter of the said writ petition is under consideration of the State. According to the learned counsel, no decision has been taken as yet. The respondents may take final decision on its own merits, 1/2

08.odt in accordance with law, with regard to the writ land i.e. whether the petitioners are entitled for the allotment or otherwise, expeditiously, preferably within eight months.

Writ petition is accordingly disposed of. No costs.

In view of disposal of writ petition, civil application also stands disposed of.
