Present application is filed for grant of bail on account of arrest of applicant in Crime No.0497 of 2023 registered at Chalisgaon Police Station, District Jalgaon for the offences punishable under Sections 420, 467, 467, 471 r/w 34 of the IPC. 2.

Learned counsel for the applicant submitted that, present application is successive bail application. That, previous bail application was rejected by the trial Court as well as this Court.

943-BA-132-25.odt {2} However, now investigation is over and charge-sheet is already filed in January 2024. It is pointed out by the learned counsel that, though trial has commenced, only two witnesses are examined, and there is a long list of prosecution witnesses, and therefore, no immediate chance of matter going to conclusion, and hence, relief of bail is urged for.

Learned APP opposed the bail application on the ground that, trial has already commenced. That, two witnesses are already examined and mere 18 to 19 witnesses are to be examined by the prosecution, and as such, according to him, there are bright chances of trial coming to an end, if accused also cooperates.

In he light of above, without entering into the merits, when already two witnesses are examined, and there are 19 witnesses said to be examined by the prosecution, this Court trusts and believes that, learned trial Judge will definitely make endevour to conclude the trial as early as possible. With these observations, application is disposed of.
