Learned counsel for the applicant makes a statement that, inadvertently under the instructions of the relatives of the applicant - convict, he has filed the appeal as well as application for condonation of delay. Now it is revealed to him that the convict has already filed appeal challenging the conviction recorded against him, bearing Criminal Appeal No.776/2018. In view of this, he seeks leave to withdraw the application and the appeal.
