BENCH AT AURANGABAD 10 WRIT PETITION NO.1659 OF 2020 MAYUR SURYABHAN THAKUR AND ANOTHER THROUGH FATHER SURYABHAN RAMKRISHNA THAKUR ..PETITIONER

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ..RESPONDENTS ...

Mr. K. T. Shirrurkar, Advocate for the Petitioner. Mr. A. R. Kale, AGP for Respondents-State.

...

CORAM : S. V. GANGAPURWALA & SHRIKANT D. KULKARNI, JJ.

DATED : 27th JANUARY, 2020.

PER COURT:- 1.

The petitioner has remedy of Appeal against the impugned order. The petitioner relies on the order passed by this Court in Writ Petition No.9767/2019 on 06.08.2019. In the said order we had very categorically observed that in normal course, we would have relegated the petitioner to the remedy of Appeal before the committee.

However, only because of the exigency existing that the caste certificate was required to be submitted before 14.08.2019, we had entertained the petition. 2.

In the present case, according to the petitioner he has been admitted from Open category and has not taken the benefit of reservation. He is prosecuting his first year Diploma course.

(2) 10-wp-1659-2020 3.

No such exigency exists for us to exercise our writ jurisdiction. More particularly, in light of the remedy of Appeal available to the petitioner.

4.

Writ Petition is disposed of with liberty to the petitioner to avail the remedy of Appeal. 5.

All contentions are kept open. No costs.

(SHRIKANT D. KULKARNI) (S. V. GANGAPURWALA) JUDGE JUDGE Devendra/January-2020
