Learned Advocate Mr. D. S. Ingole holding for learned Advocate Mr. N. S. Ghanekar submits that now the charge-sheet is filed and, therefore, on instructions, he prays for withdrawal of the appeal with liberty to make an application before the learned Special Judge for bail.

It is to be noted that the appeal is yet to be admitted. Under such circumstance, there is no hurdle in allowing the appellant to withdraw the appeal, which was, in fact, under Section 14-A(2) of the - 1 -

Under such circumstance, the appeal stands disposed of as withdrawn with liberty as prayed.
