PER COURT :- The petitioner claims to belong to Koli Mahadev Scheduled Tribe. Since the petitioner has been admitted to Engineering Course as against a seat earmarked for scheduled Tribe category, his Tribe certificate has been referred for verification to the scrutiny committee. The validation claim of the petitioner is stated to be pending with the committee.
In this view of the matter, this petition can be disposed of with direction to the scrutiny committee to take decision on the validation claim of the petitioner, as expeditiously as possible and preferably within a period of three months from today and it is accordingly directed.
{2} wp 1424.16.odt The petitioner contends that, he has already appeared for the last semester of final B.E. Examination in the month of May, 2015 and has been declared successful. However, the University has refused to issue the degree certificate and the College has withheld the original documents submitted by the petitioner. Since the petitioner has already completed the Engineering Course, the University is directed to issue him degree certificate, so also, respondent No.3 is directed to return back the original documents submitted by the petitioner forth with. The petitioner undertakes not to secure benefits as a member belonging to ST category for pursuing further studies or for securing employment or any other benefits under the Government Policy until validation of the Tribe certificate by the competent scrutiny committee. In the event of failure of the petitioner to secure validation Certificate, he shall not be entitled to claim any benefits available for reserved category.
With the directions as above, the writ petition stands disposed of.
