PER COURT :- 1) Heard. The grounds urged for causing interference in the order under review passed by the Division Bench on 16th December, 2009 in WP No.3236/2009, are of such nature, which are required to be considered by the appellate authority. The Review Application, seeking review of the order, cannot be considered an appeal, in disguise. The Division Bench of this court, while disposing of the writ petition has in para 3 of the order has observed that, - "the seniority list is one and the same and it cannot be tinkered with even if the petitioners get exemption from appearance and passing the Departmental Examination" and the relief of seniority claimed by the petitioner has been turned down. We do not find any reason to cause interference in the order passed by the Division Bench of this court on 16th December, 2009. The Review Application stands rejected.
