Heard both the sides.

Present applicant, who is arrested by Nagar Taluka police station in crime No. 42 of 2014 for the offence punishable under section 395, 394, 342 read with 34 of the Indian Penal Code, is praying for his release on bail.

Earlier application of the present applicant, bearing Criminal Application No.3835 of 2014 was allowed to be withdrawn by this Court, vide order dated 4th August, 2014, with

{2} liberty to file similar application in this Court in case the trial is not concluded within a period of six months.

Report of the learned Sessions Judge, received to the learned APP, would show that the trial would take its own time. The facts would go to show that the co-accused are released on bail. Test Identification parade could not be held. Learned APP submits that as the complainant is resident of Jabalpur, despite several efforts the Test Identification Parade could not be held and the charge sheet was required to be filed. 5.

Considering the allegations and that the trial may take its own time, following orderORDER I.

The application is hereby allowed.

The applicant be released on bail in Crime No.42 of 2014 of Nagar Taluka Police Station, District - Ahmednagar for the offences punishable under section 395, 394, 342 read with 34 of the Indian Penal Code, upon his executing P. R. bond in the sum of Rs.20,000/- (Rupees Twenty Thousand) and also upon furnishing surety in the like amount.

The applicant shall attend Nagar Taluka police station on every second and fourth Tuesday between 9 and 10 am for six months from the date of his release and shall maintain diary regarding his presenty, by obtaining signature of the concerned police station in charge.

Accordingly, the application is allowed and disposed of.
