IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.4061 OF 2014 Faiyaz Ahmed Qureshi Petitioner

Versus

Bank of Baroda & another Respondents Mr.S.S.Kazi, advocate for the petitioner CORAM : R.M.BORDE & P.R.BORA, JJ.

DATE : 06th February, 2015 PER COURT:

Petitioner is aggrieved by the order of rejection of Contempt Application presented by him against the Respondents, passed by the Debts Recovery Tribunal on 08.11.2013.

On perusal of the judgment delivered by the Debts Recovery Tribunal, it transpires that the grievance raised by petitioner is substantially met. The possession of attached property has been handed over to the petitioner and the Tribunal, in the facts of the case, did not deem it necessary to proceed further against the contemnors. On perusal of the order, it appears that the Tribunal has taken a reasonable view of the matter and as such, in exercise of extraordinary jurisdiction under Article 226 of the Constitution, no interference is called for. Writ Petition is devoid of substance.

Writ Petition stands dismissed. Pending Civil application does not survive and is disposed of.
