This is an Application for condonation of a delay of 3317 days caused in preferring the Appeal against the Judgment and Award dated 18.09.2010, passed by the learned Civil Judge Senior Division, Latur in L.A.R. No. 200 of 2009.

It is submitted by the learned Advocate for the Applicant that sufficient reasons are shown in the Application, which prevented the Applicant, who is original claimant, from preferring the Appeal within the stipulated period. He submits that the Applicant undertakes that he will not be entitled for the statutory benefits and the interest for the aforementioned delayed period. He submits that the Application be allowed.

The Application is opposed by the learned AGP for Respondents No. 1 and 3. None for Respondent No. 2, though duly served.

After hearing the learned Advocate for the Applicant and the learned AGP for Respondent Nos. 1 and 3, and on going through the Application, and for the reasons mentioned in paragraph nos. 1, 2 and 3, the Application is allowed in terms of prayer clause 'B'. The Applicant shall not be entitled to statutory benefits and interest for the aforementioned delayed period. A copy of this order be kept along with the Appeal memo in this matter.
