Heard Mr. Awate, the learned counsel for petitioners and Mr. Bankar Patil the learned counsel for respondent Nos. 2 to 5. The petition is filed challenging advertisement dated 20.03.2003 inviting applications for 749 posts of Shikshan Sevaks. 2.

This Court in the year 2003 itself vacated the interim relief earlier granted to petitioners. Subsequently selection process must have been undertaken by now. It is not the case that, the petitioners had participated in the selection process were selected and their names appeared in the select list.

In the light of the above and further in view of the fact that, as per the Right to Education Act, the parameters have also undergone change. The relief claimed cannot be considered. The writ petition as such is disposed of. In case petitioners, are otherwise eligible and any fresh advertisements are issued, needless to state the petitioners would be entitled to apply, if they fulfill the eligibility criteria.
