Mr Thombre, learned Counsel for the petitioner submits that upto 2016-17, the petitioner-institution was allotted center for XIIth Standard examinations. For the first year, the center was not allotted. This year, the petitioner had made an application on 11th January 2018. No communication was made by the board to the petitionerinstitution. The petitioner-institution has strength of 263 students and the students of the petitioner-institution have to travel 4 Kms. to attend the another center for giving examination of XIIth Standard. The center is allotted to an institution having only 80 students. In fact, the petitioner-institution is not required to make the application. It is for the board to consider all the circumstances and allot the center. It is favouring to another center.

We have heard Ms Mahajan for respondent no.2 also. 3.

In the affidavits-in-reply on record, it is stated that the proclamation was issued by the board and on the website, the schedule was also placed for the examination. The affidavit states that the petitioner had not submitted any proposal for examination center after 31st August 2015.

Be that as it may. Last year, the petitioner-institution was not allotted examination center for XIIth Standard. Now, the written examinations are to commence from 21st February 2018. Hall tickets are also allotted. The question papers are also sent to the custodian. All arrangements, it appears are made.

Petitioner, if so advised may make his request for center for the next examination in advance, which would be considered by the authority on its own merits.

Writ Petition disposed of. No costs.
