The learned counsel for the petitioner submits that the petitioner has filed application for rental compensation with respondent No.1. In the year 2017, the same is not yet decided by respondent No.1.

The learned Addl. Govt. Pleader accepts notice for respondents/State and submits that the petitioner has not given the details of the date when possession of land was taken and date of notification under Section 4 of the Land Acquisition Act, 1894. 3.

The award is passed in the year 1994. The application for rental compensation is filed in the year 2017.

It is for the respondent No.1 to take decision on the application filed by the petitioner for rental compensation considering all the relevant aspects of the matter.

In case, the application is filed by the petitioner and if the same is pending with respondent No.1 (Page-10), the respondent No.1 is competent to decide it, the same shall be decided on its own merits upon hearing all the parties concerned considering all the relevant aspects of the matter, preferably within a period of nine months.

Writ Petition is disposed of. No costs.
