A] ORDER IN CIVIL APPLICATIONS FOR STAY 1] The learned counsel for the applicants submits that the Land Acquisition Officer has granted compensation
at the rate of Rs.750/- per R. and Reference Court has granted compensation at the rate of Rs.6950/- per R. i.e. about more than 9 times increase. The learned counsel for the applicants further submits that in connected group of appeals, this Court has granted stay subject to deposit of 50% of the amount of compensation, by order dated 7th January, 2021 in Civil Application No.257 of 2021. In Civil Application No.11001 of 2021 in First Appeal Stamp No.10977 of 2021 wherein this Court has also granted stay on depositing 50% of the amount of award passed by the Reference Court along with accrued interest thereon till date.
2] In view of the same, ad-interim stay is granted subject to deposit of 50% amount of compensation as directed by the Reference Court along with accrued interest thereon till date, within a period of 12 weeks from today. B] ORDER IN CIVIL APPLICATIONS FOR DELAY 1] The present Civil Applications are filed to condone the delay of 84, 85, 86 and 88 days respectively in filing First Appeals.
2] For the reasons stated in the Civil Applications, the same are allowed. Delay is condoned. Appeals are registered. Civil Applications are disposed of accordingly.
3] Issue notice to the respondents in First Appeals, returnable on 9th February, 2024.
